Kosovo and Serbia Militias Threaten Violence

Shadowy armed groups from Kosovo and Serbia have warned they are ready to fight over a controversial monument to Albanian guerrilla fighters.

Belgrade, PristinaTensions have escalated further over the memorial to ethnic Albanian fighters in the southern Serbian town of Presevo which the Belgrade authorities want to demolish but whose supporters have vowed to defend.

Two separate groups – one from Kosovo, one from Serbia – have threatened to take up arms over the dispute.

The Albanian National Army, ANA, which is blacklisted as a terrorist organisation in the US, said it had started mobilising members against what it sees as Serb threats to take part of Kosovo’s territory and forcibly remove the memorial….

The Balkans‘ uncharacteristically silent exit from the world stage as
the most prominent international hot spot of the last decade belies its
status as a major recruiting and training center of Osama bin Laden’s
al Qaeda network. By feeding off the region’s impoverished republics
and taking root in the unsettled diplomatic aftermath of the Bosnia and
Kosovo conflicts, al Qaeda, along with Iranian Revolutionary
Guard-sponsored terrorists, have burrowed their way into Europe’s
backyard.

For the past 10 years, the most senior leaders of al Qaeda have visited
the Balkans, including bin Laden himself on three occasions between
1994 and 1996. The Egyptian surgeon turned terrorist leader Ayman
Al-Zawahiri has operated terrorist training camps, weapons of mass
destruction factories and money-laundering and drug-trading networks
throughout Albania, Kosovo, Macedonia, Bulgaria, Turkey and Bosnia.
This has gone on for a decade. Many recruits to the Balkan wars came
originally from Chechnya, a jihad in which Al Qaeda has also played a
part.

These activities have been exhaustively researched by Yossef Bodansky,
the former director of the U.S. House of Representatives‘ Task Force on
Terrorism and Unconventional Warfare. The February testimony of an
Islamist ringleader associated with the East Africa bombings have also
helped throw light on these actions.

They have however been disguised under the cover of dozens of
„humanitarian“ agencies spread throughout Bosnia, Kosovo and Albania.
Funding has come from now-defunct banks such as the Albanian-Arab
Islamic Bank and from bin Laden’s so-called Advisory and Reformation
Committee. One of his largest Islamist front agencies, it was
established in London in 1994.

Narco-Jihad Culture

The overnight rise of heroin trafficking through Kosovo — now the most
important Balkan route between Southeast Asia and Europe after Turkey
— helped also to fund terrorist activity directly associated with al
Qaeda and the Iranian Revolutionary Guard. Opium poppies, which barely
existed in the Balkans before 1995, have become the No. 1 drug
cultivated in the Balkans after marijuana. Operatives of two al
Qaeda-sponsored Islamist cells who were arrested in Bosnia on Oct. 23
were linked to the heroin trade, underscoring the narco-jihad culture
of today’s post-war Balkans.

These drug rings in turn form part of an estimated $8 billion a year
Taliban annual income from global drug trafficking, predominantly in
heroin. According to Mr. Bodansky, the terrorism expert, bin Laden
administers much of that trade through Russian mafia groups for a
commission of 10% to 15% — or around $1 billion annually.

The settling of Afghan-trained mujahideen in the Balkans began around
1992, when recruits were brought into Bosnia by the ruling Islamic
party of Bosnia, the Party of Democratic Action, from Chechnya, Saudi
Arabia, Egypt, Pakistan, as well as Italy, Germany and Turkey. They
were all given journalists‘ credentials to avoid explicit detection by
the West. Others were married immediately to Bosnian Muslim women and
incorporated into regular army ranks.

Intelligence services of the Nordic-Polish SFOR (previously IFOR)
sector alerted the U.S. of their presence in 1992 while the number of
mujahideen operating in Bosnia alone continued to grow from a few
hundred to around 6,000 in 1995. Though the Clinton administration had
been briefed extensively by the State Department in 1993 on the growing
Islamist threat in former Yugoslavia, little was done to follow
through.

The Bosnian Embassy in Vienna issued a passport to bin Laden in 1993,
according to various reports in the Yugoslav press at the time. The
reports add that bin Laden then visited a terrorist camp in Zenica,
Bosnia in 1994. The Bosnian government denies all of this, but admits
that some passport records have been lost. Around that time, bin Laden
directed al Qaeda „senior commanders“ to incorporate the Balkans into
an complete southeastern approach to Europe, an area stretching from
the Caucasus to Italy. Al Zawahiri, the Egyptian surgeon reputed to be
the second in command of the entire al Qaeda network, headed up this
southeastern frontline.

By 1994, major Balkan terrorist training camps included Zenica, and
Malisevo and Mitrovica in Kosovo. Elaborate command-and-control centers
were further established in Croatia, and Tetovo, Macedonia as well as
around Sofia, Bulgaria, according to the U.S. Congress’s task force on
terrorism. In Albania, the main training camp included even the
property of former Albanian premier Sali Berisha in Tropje, Albania,
who was then very close to the Kosovo Liberation Army.

Not even stalwart NATO ally Turkey escaped the network. Areas beyond
government control were also visited by bin Laden in 1996 according to
London-based Jane’s Intelligence Review. The government has been
battling two terrorist groups: Jund al Islam, whose assassinated Syrian
leader was one of bin Laden’s closets confidantes, and the Kurdish PKK,
whose leader, Abdullah Ocalan, merged his group’s activities with those
of Iran’s Hezbollah in 1998.

Controversial Relationship

By early 1998 the U.S. had already entered into its controversial
relationship with the KLA to help fight off Serbian oppression of that
province. While in February the U.S. gave into KLA demands to remove it
from the State Department’s terrorism list, the gesture amounted to
little. That summer the CIA and CIA-modernized Albanian intelligence
(SHIK) were engaged in one of the largest seizures of Islamic Jihad
cells operating in Kosovo.

Fearing terrorist reprisal from al Qaeda, the U.S. temporarily closed
its embassy in Tirana and a trip to Albania by then Defense Secretary
William Cohen was canceled out of fear of an assassination attempt.
Meanwhile, Albanian separatism in Kosovo and Metohija was formally
characterized as a „jihad“ in October 1998 at an annual international
Islamic conference in Pakistan.

Nonetheless, the 25,000 strong KLA continued to receive official
NATO/U.S. arms and training support and, at the talks in Rambouillet,
France, then Secretary of State Madeleine Albright shook hands with
„freedom fighter“ Hashim Thaci, a KLA leader. As this was taking place,
Europol (the European Police Organization based in The Hague) was
preparing a scathing report on the connection between the KLA and
international drug gangs. Even Robert Gelbard, America’s special envoy
to Bosnia, officially described the KLA as Islamic terrorists.

With the future status of Kosovo still in question, the only real
development that may be said to be taking place there is the rise of
Wahhabi Islam — the puritanical Saudi variety favored by bin Laden —
and the fastest growing variety of Islam in the Balkans. Today, in
general, the Balkans are left without the money, political resources,
or institutional strength to fight a war on terrorism. And that, for
the Balkan Islamists, is a Godsend.

Ringjallet “AKSH”, ultimatum Jahjagës dhe Hashim Thaçit

Një grup i vetëquajtur Forcat e Armatosura të Shqipërisë Etnike i është drejtuar nëpërmjet një ultimatumi presidentes së Kosovës dhe kryeministrit Thaçi që të krijojnë sa më shpejt Forcat e Armatosura të Republikës së Kosovës (FARK). Sipas tyre, data në të cilën ultimatumi skadon është 30 shtatori i këtij viti ose në të kundërt, FASHE do fillojë veprime luftarake në veri të Kosovës.

“Pjesë e FARK duhet të jenë Armata e Republikës së Kosovës (ARK) dhe Policia e Kosovës”, – tha përmes një prononcimi në emër të Komandës Supreme të FASHE-s, zëdhënësi politik, Dr. Kolonel Sazan Toplica.

Sipas deklaratës, FASHE është vazhdimësi e Armatës Kombëtare Shqiptare që vepron që prej vitit 2001 në Maqedoni, Kosovë dhe Pollog (Malet e Sharrit) dhe qe drejtohej nga Idajet Beqiri, Gafurr Adili dhe Taip Mustafa. Të tre këta të fundit patën probleme me drejtësinë shqiptare. Por FASHE thekson se AKSH nuk është shpërbërë. Tashmë, efektivët e saj e vënë theksin në çështjen e veriut të Kosovës, bashkimin e të gjithë trojeve shqiptare si dhe konsolidimin e Forcave të Armatosura të Kosovës.

Skopje. Seventy-four shells and mine-throwers have been found in a special pillbox close to the border with Albania in the village of Vrbjane, 10 km away from Gostivar, the Macedonian Kanal 77 informed.
The pillbox is in the area that in the time of the military conflict was within the responsibilities of the 116th brigade of the National Liberation Army. Nevzat Bejta, current mayor of Gostivar, was its member. After it was announced that masked persons in black uniforms controlled the movement in Kosovo as far as the eastern border with Serbia, the Albanian National Union Front, headed by Gafur Adili, released on the Internet an announcement that a “Tahir Sinani” brigade had been formed, which in the frames of the Albanian National Army /ANA/ should function in Macedonia.
The Tahir Sinani unit will perform the function of a second ANA division, with its area of action being Vardar valley, Ilirida. The paramilitary unit was named after Tahir Sinani, colonel in the Kosovo Liberation Army /KLA/, who died some years ago in mysterious circumstances.
Xhezair Shaqiri, known as Commander Hoxha, thinks Gafur Adili, who represents himself as a political leader of the Albanian National Union Front, is an Internet fighter only, who had not done anything in all wars in the region up to now. Hoxha said he did not have any information about the ANA and its formations on Macedonian territory.

PRISTINA, Serbia, Oct 4 (Reuters) – Kosovo public television has broadcast footage of masked and armed members of a self-proclaimed guerrilla army who said they were ready to fight for Kosovo’s independence from Serbia.

The report, filmed by an independent journalist, was broadcast on Wednesday evening on Radio Television Kosovo.

The ethnic Albanian majority in the southern Serbian province is growing increasingly frustrated with the West’s stalled bid to grant it independence in the face of Serb and Russian opposition.

The men, dressed in black and holding automatic weapons and sniper rifles, said they were members of the outlawed Albanian National Army (ANA), a group branded „terrorists“ in 2003 by the United Nations mission that has governed Kosovo for eight years.

„Following serious threats of war … by Serb paramilitaries, and that Serbia will again invade Kosovo, we are forced to be ready and aware,“ said one man, his face hidden by a black balaclava. There were around 10 men in the film.

A spokesman for the NATO force, KFOR, said the ANA statement was „inappropriate“.

„They will of course be treated as illegal persons by the relevant services … if we catch them or meet them,“ said Colonel Bertrand Bonneau. NATO has 16,000 troops in the province of 2 million people, 90 percent Albanians.

The men in the video wore insignia almost identical to that of the Kosovo Liberation Army, a guerrilla army that battled Serb forces in 1998 and 1999 and drew NATO into its first ‚humanitarian‘ bombing war to halt the slaughter and ethnic cleansing of Albanian civilians.

The ANA surfaced after the war in Kosovo and Albanian insurgencies in southern Serbia and Macedonia in 2000 and 2001.

Amid the already heightened tensions surrounding the fate of the UN-administered Serbian province of Kosovo, the reappearance of several armed groups is further jangling nerves.

The appearance on the province’s main broadcaster, Radio-Television Kosova (RTK), of balaclava-clad men claiming allegiance to the outlawed Albanian National Army (Armata Kombetare Shqiptare: AKSh) in October 2007 drew condemnation from international, Serbian and Kosovar politicians alike. However, it is in the interests of both Belgrade and Pristina to exaggerate the presence of Albanian armed groups, although from opposite standpoints.

Demonstrating the frustration of Kosovo’s 90 per cent Albanian majority could put pressure on the international community to grant Kosovo independence more quickly. Therefore, while publicly condemning AKSh’s actions and rhetoric, the hand of Kosovo’s Unity Team (the group of five Kosovo Albanian political parties taking part in last-ditch negotiations with Belgrade in October) will have been strengthened.

At the same time, Serbian politicians are convinced that Kosovo’s Albanian population is not competent to govern itself, and regularly warn that the province will turn into a black hole for organised crime if given independence. They also argue that Kosovo’s indigenous governing institutions are unwilling or unable to protect the rights of minorities (specifically Kosovo Serbs) in Kosovo without an international presence. The presence of armed groups harassing civilians in Kosovo Liberation Army-style outfits bolsters this rhetoric.

Kosovo will likely declare independence unilaterally in the coming weeks, which will probably be recognised by the US, France, the UK, Italy and Germany relatively quickly. The reaction of these different armed groups will be crucial to Kosovo’s short- and medium-term stability, but perhaps more than that, the way the media in Kosovo and Serbia report any reactions will have a lasting impact on inter-ethnic relations, regardless of the security threat actually posed by these groups.

Die AKSH hat sich in den vergangenen Jahren mehrfach zu Anschlägen auf staatliche Einrichtungen in Mazedonien und Serbien bekannt. Spektakulärste Aktion war die Sprengung einer Eisenbahnbrücke zwischen Serbien und dem Kosovo. Aufgrund dieses Anschlags wurde die AKSH im April 2003 letztendlich von der UNMIK-Administration im Kosovo als terroristische Organisation eingestuft und verboten. Über ihre Homepage versuchte die Organisation die im Ausland lebenden Landsleute über Ziele und Veranstaltungen zu informieren und zur Teilnahme zu animieren. Tagesordnungspunkte waren unter anderem die Mitgliederwerbung sowie die Organisation von Spenden-sammlungen. Das Spendenaufkommen in Deutschland blieb jedoch hinter den Erwartungen der Verantwortlichen zurück. So konnten weniger finanzielle Mittel als erwartet in die Heimat transferiert werden, um den „Befreiungskampf“ ihrer Kämpfer nachhaltig zu unterstützen.

Anfang 2003 starteten Funktionäre der AKSH/FBKSH eine Serie von Informationsveranstaltungen in Deutschland (beispielsweise in Freiburg, Mannheim und Ditzingen/Kreis Ludwigsburg, und Esslingen), Österreich, Schweiz, Belgien, England und in Schweden, um Strukturen in den einzelnen Ländern aufzubau-
en bzw. zu stärken.

Am 15. Dezember 2003 wurde der politische Sekretär der FBKSH, Idajet BEQIRI bei der Einreise in die Schweiz festgenommen, am 15. Juni 2004 aus der JVA Konstanz entlassen und nach Albanien ausgeliefert.

Idajet BEQIRI, wohnhaft gewesen in Belgien und dort Asylberechtigter, nahm seit 2002 regelmäßig an Informationsveranstaltungen der FBKSH und des von der Organisation initiierten „Albanischen Nationalfonds“ (FKSH) teil. Auch in Baden-Württemberg konnte er als Referent bei Veranstaltungen beispielswe-
ise in Freiburg, Ditzingen und Esslingen festgestellt werden. Grundlage für seine Festnahme war ein internationaler Haftbefehl Albaniens vom Sommer 2003, in dem er unter anderem der Volksverhetzung und Aufstachelung zum ethnischen und religiösen Hass in Albanien beschuldigt wird.

Auf Grund der Festnahme von BEQIRI organisierten Anhänger damals europaweit mehrere Demons-trationen. Durch Verlautbarungen und eine Petition unter anderem an den Deutschen Bundespräsidenten und den Deutschen Bundestag versprachen sich die Verantwortlichen der Organisation die Aussetzung der Auslieferung ihres Führungsfunktionärs.

Die Ausweisung von BEQIRI hingegen hatte in extremistischen kosovo-albanischen Kreisen keine öffentliche Resonanz gefunden. Dagegen wurden FBKSH-Anhänger im Internet anlässlich des ersten Pro-
zesstages am 23. Juni 2004 in Tirana/Albanien zu Solidaritätskundgebungen aufgerufen. In Baden-Württemberg wurden keine derartigen Veranstaltungen durchgeführt.

Seit der Auslieferung von BEQIRI nach Albanien fehlt den in Deutschland, aber auch in den benachbarten Ländern (Schweiz, Österreich und Belgien) lebenden Anhängern der Vereinigung die politische Leitfigur. Einhergehend mit einer gewissen Verunsicherung über das konsequente Vorgehen der Sicherheits-behörden gegen Aktivisten der FBKSH auch in anderen Ländern wurden in Deutschland keine öffentlichen Informationsveranstaltungen mehr organisiert.

Osama bin Laden Focuses on the Balkans for the New Wave of Anti-Western Terrorism

Starting in mid-August 2003, radical Islamist leaders elevated the rôle of the terrorism infrastructure in the Balkans as a key facilitator of a proposed escalation of conflict into the heart of Europe, Israel and the United States. The terrorism campaign aims to define the US occupation of Baghdad as the turning point in the fateful jihad for the future of Islam. The importance of the concurrent expansion of Islamist operations in the Balkans should be examined in this overall context.

The most telling development was the nomination of Shahid Emir Mussa Ayzi to coordinate and run special recruitment operations. Ayzi is a veteran of Afghanistan who is close not only to the al-Qaida élite but also the Taliban leadership. Recently, al-Qaida leader Osama bin Laden’s senior commanders decided to expand the recruitment and activation of Slav cadres, because they look European and non-Arabs, in order to enhance their ability to operate at the heart of the West.

In August 2003, Ayzi took over this sensitive recruitment drive. The main recruitment pool consists of Bosnian Muslims with a smaller effort relying on Russian converts recruited in Chechnya and the Caucasus as a whole. Although the Islamists had run a recruitment and training drive of Bosnian Muslims expert terrorists and would-be martyr-bombers since the early 1990s, these cadres had not until now been used.

Now, circumstances seem to be changing. In late August 2003, Ayzi sent a report to Mullah Qudratullah, a senior Taliban official, about his success in enlisting “persons of Slav ethnicity” to the Islamist jihad. He added that some of these “white devils” had already been indoctrinated and trained to the point of sending them to carry out “Allah’s Work” — that is, terrorist martyrdom-strikes — “in a number of European cities and on Israeli territory”. The preparation of additional Slav cadres for US operations is in progress, Ayzi reported. The training and preparation of Ayzi’s recruits is taking place in the Balkans and the Caucasus, mainly Georgia.

The Balkans undertaking is part of an overall increase in the Islamist buildup under the overall supervision of Muhammad al-Zawahiri, the brother of Ayman al-Zawahiri, the number two leader in al-Qaida. The senior Islamist commanders now consider what they call “the Albanian land” — Albania, Kosovo and parts of Macedonia — to be safe for use a springboard for the insertion of a new wave of expert terrorists, including the Slavs, into Western Europe and onward throughout the West.

Indeed, starting in mid-August 2003, there was a discernable increase in the number of foreigners in the Islamist mosques throughout Albania. “They [originally] come from Turkey, Saudi Arabia, Pakistan, and Iran. They come from many countries,” noted an eyewitness in Tiranë. “They arrive [in Tiranë] from Afghanistan,” he added. These expert terrorists are being prepared in Albania for their specific missions in the West.

This training program is conducted under the cover of the Albanian National Army (ANA or AKSh in Albanian) with most senior trainers and commanders being “mujahedin who retreated from Bosnia” and are affiliated with al-Qaida.

In return for the Albanian support of this endeavor, the Islamists assist the local terrorists in preparing for launching spectacular terrorism into the major cities of Serbia and Montenegro, with Belgrade and Niš believed to be the top targets. As well, Islamist cadres, mainly veterans of Bosnia, are providing advance training to thousands of Albanian terrorists in camps in Kosovo-Metohija, near Prizren, on the slopes of Mt Sara, in the Kosovo Morava River valley, in the Albanian towns of Kukes and Tropoje, and around Tetovo in western Macedonia.

These operations are also run under the banner of the ANA/AKSh.

Significantly, the growing importance of the Balkans cause was also reflected in the Islamist communiqués claiming and explaining the bombing of the UN building in Baghdad. This was the most important and authoritative doctrinal statement of the Islamist leadership in August 2003. The statements stressed the situation in Bosnia as a major grievance of the Islamists against the UN and the West. The first statement was issued on August 19, 2003, by the Abu-Hafs al-Masri Brigades, itself a front group of al-Qaida. The Islamists claimed that UN officials “oversaw the massacre of Bosnian women and children in 1992 and 1995”, and that “the United Nations was responsible for the massacre of 7,000 Muslims in Srebrenica in 1995 because it sponsored the idea of ‘not establishing an Islamic state in Europe’.”

On August 24, 2003, the London-based Al-Muhajiroun, bin Laden’s primary mouthpiece in Europe, elaborated on this theme in order to explain why the UN building in Baghdad was a legitimate target: “Verily it was the UN soldiers in Bosnia who were recorded to have stood by when the barbaric Serbs massacred Muslims. The UN first decided to take away the weapons of the Muslims (fearing that they might actually defend themselves and establish Islamic rule) and thereby facilitated their massacre, and were then even photographed helping in the mass murder and gang rape of Muslim women and children. The wounds are still fresh.”

The statements were clearly intended to compound the disinformation that, indeed, 7,000 Muslims were killed in Srebrenica, when all independent forensic evidence points to Muslim casualties in the hundreds, possibly the low hundreds. Continued emphasis on such allegedly high numbers of Muslim deaths at Srebrenica also obfuscates the Muslim murders in that city, earlier, of Serb civilians.

Indeed, the August 2003 statements and intelligence, leading up to the proposed September 2003 opening of the new Islamist shrine — built at Srebrenica with US funds — all support analysis that a significant new wave of terrorism, this time with many European Islamists, is to begin soon.

The Macedonian police has confirmed that its officers killed four gunmen and seized a considerable quantity of weapons last night near the village of Radusha on the border with Kosovo.The shootout occurred Tuesday night when a special unit of the police stopped a lorry after being tipped off that it was transporting illegal weapons, police spokesman Ivo Kotevski told Balkan Insight.

An armed group then began shooting at the police, which returned fire and killed four persons, according to police reports. The police suffered no casualties.

Three of the four killed gunmen have now been identified, Macedonia’s Net Ptress news agency reported. According to the agency, two of those killed were Macedonian citizens and one was from Kosovo. The Macedonian residents were reportedly from the villages of Grchec and Merovo, while the Kosovar was from Pristina.

Representatives of the police said they would announce further details about the incident later during the day. The seized weapons are being examined.

So far it is not clear whether this incident is linked with another in late April when the police in the same border region with Kosovo found a large weapons stash and clashed with the uniformed gunmen who were guarding it…………..

Question: It is no secret that the United States is preparing a helicopter base and an LNG terminal near Alexandropoulos in northern Greece near Russia’s planned gas hub on the Turkish-Greek border. It looks as if the United States is trying to shut the door, both symbolically and practically, on Russia’s energy cooperation with Greece, the Balkan states and Southern Europe. Do you think that this kind of pressure can complicate or worsen Russian-Greek relations?

In the next few days, dispute talks will be resumed over the name of Greece’s neighbouring country, Former Yugoslav Republic of Macedonia. The Greeks believe that the name „Macedonia“ is unfair because the greater part of the ancient state of Macedonia belongs to Greece and that the name “Macedonia” represents a possible territorial claim over Greek territory. Russian officials said in the past that you might revise the name under different conditions. Can you comment on this?

Sergey Lavrov: Russian officials said this? We have recognised Macedonia as the Republic of Macedonia, and only as this.

Question: What if conditions change? Will a new compromise be possible then?

Sergey Lavrov: I have spoken about the subject of gas. We see some fear of honest competition in US actions. Since it is unable to compete honestly now, the United States have started using unfair methods of competition and political pressure to force European countries to build the necessary facilities for buying more expensive gas. The choice rests with European countries. We believe that they must be aware of their economic interests. If they are willing to pay more in this situation, then this is their decision.

Our projects on the diversification of gas routes to Europe include Nord Stream 2, which I have mentioned, and Turkish Stream, which can be possibly extended to Europe. As of now, we are only building a line for the Turkish consumers. A second line will be built only if we receive ironclad guarantees from the European Commission that they will not do what they have done to the planned South Stream pipeline towards Bulgaria, which seems to be willing to discuss the possibility of hosting a second line of the Turkish Stream pipeline again. We can do anything if we are doubly sure that the European Commission will not derail this project.

Of course, we are monitoring the discussions that are underway at the European Commission to introduce retroactive rules to hinder the implementation of Nord Stream. It is a dirty game. I hope that the purely economic nature of this project, as well as the support the leading European energy companies have given this economic and commercial project, will prevent any foul play.

As for the resumption of talks and efforts to settle the dispute over the name “Macedonia”, they were in limbo for a long time and only resumed when the United States decided that Macedonia should be admitted to NATO. Since Greece is a NATO state you don’t need any concessions. But Macedonia, which is being encouraged to join NATO, needs them. It is as simple as that.

No matter which name Greece and Macedonia agree on for the Former Yugoslav Republic of Macedonia, it will be generally recognised if it is adopted officially and sealed in the Constitution of the Republic of Macedonia. I hope that everyone can see the real meaning of the current developments. The point at issue is not to ensure respect for any common or specific features of two kindred peoples, but to ensure that one of them joins NATO.

Question: Last year, two Russian citizens, Grigory Tsurkanu and Roman Zabolotny, were captured in Syria. There was video evidence of their captivity. My colleagues from the channel talked to Grigory Tsurkanu’s parents, who sent inquiries to the Russian Foreign Ministry, the Executive Office of the Russian President, the Federal Security Service (FSB) and the Ministry of Defence of Russia. There has been no information on their fate, on what happened after their captivity. Defence Ministry sources suggested informally that, perhaps, this information has been classified, although, officially, they were not army servicemen. According to one version, they might have been members of a private military company. Do you know anything about these persons? Can you check if the inquiry reached the Foreign Ministry? Is there information on Russians taking part in operations in other countries on contract?

Sergey Lavrov: There is nothing I can add to what you have said. We know about the reports that you have mentioned. We look into the fate of any Russian citizen wherever he or she might be, if we receive reports that he or she was either reported missing or got into trouble. The whereabouts of our two citizens whom you have mentioned is unknown. Steps are being taken, above all, by our military, to determine their location, and collect and verify corresponding information. As soon as anything becomes clear, we will readily report this.

As for other countries, this practice is widespread in many states. This was the case in Iraq and other countries of the region, where so-called Blackwater, which was renamed later, used to operate. I think that we need to clearly define the legislative basis so that these people are also covered and protected by the law.

…SIX YEARS AFTER THE AACL RETAINED A LEADING BRITSH LAWYER TO REPESENT
ALBANIAN AMERICANS TORTURED AND JAILED IN PODGORICA

 

New York, New York – November 25, 2015 – The European Court of Human Rights in Strasbourg, France, delivered their judgment on November 24 in the case of Kola Dedvukaj & Rrok Dedvukaj v. Montenegro.  The Dedvukajs (who are not related) were represented by Steven Powles—a specialist in international criminal law and human rights—who was retained by the Albanian American Civic League in 2009, shortly after Kola and Rrok Dedvukaj were released from three years of incarceration in the federal prison in Podgorica.

 

Powles, who is a barrister at Doughty Street Chambers in London, was part of a legal team that the AACL’s Balkan Affairs Adviser Shirley Cloyes DioGuardi and President former Congressman Joe DioGuardi had previously worked with on the defense of UCK commanders.  Powles was one of the lawyers defending members of the Kosova Liberation Army before the International Criminal Tribunal for the Former Yugoslavia (ICTY), which resulted in the acquittal and release of Fatmir Limaj and Isak Musliu in 2005.

 

From September 2006 to 2009, the Civic League worked with Members of the US Congress, including the late Congressman Tom Lantos, Congressman Dana Rohrabacher, Congresswoman Ileana Ros-Lehtinen, and then Senator Joe Biden, to secure the freedom of fourteen Albanians, including three Albanian Americans, who were arrested, tortured, and imprisoned in Montenegro in September 2006 on suspicion of terrorist activity.  When that effort—including Congressman Lantos’s appeals to Prime Ministers Djukanovic and Sturanovic for clemency—failed, the Civic League decided to take the Republic of Montenegro to court.

 

The application, which was submitted to the European Court of Human Rights (ECHR) by Steven Powles in January 2010, outlined the violation of the following rights:

 

Article 3 (the prohibition of torture), detailing the subjection of the Dedvukajs to torture, inhuman, and degrading treatment by the Montenegrin police when they were arrested on the morning of September 9, 2006, and documenting the lack of any effective official investigation into this matter

 

Article 5 (the lack of liberty and security of the persons), clarifying that the Dedvukajs were not informed promptly of the reasons for their arrest and any charge against them, and that they were held without charge from September 9, 2006, to December 2007

 

Article 6 (right to a fair trial), in which the main evidence against the Dedvukajs, resulting in their convictions, hinged on a diary by Anton Sinishtaj, which was obtained in an unlawful search, and the Dedvukajs were unable to examine the statement that Sinishtaj made to the police

 

Article 14 (prohibition of discrimination) safeguards individuals from discrimination on any ground such as race, language, religion, gender, and political opinion.  The application stated that the denial of a five-judge court, instead of the three-judge court that heard the Dedvukajs’ case in Podgorica, appears to have been impacted by an arbitrary and discriminatory basis due to the Albanian ethnicity of both men.

 

The application submitted by Steven Powles was merged with Sinistaj and Others v. Montenegro.  The Sinistaj’s lawyer had applied to the Supreme Court and the Constitutional Court in Montenegro, unlike the local lawyer, Kol Camaj, representing the Dedvukajs until they were released from prison in 2009.

 

The Court rejected the complaint on Article 3 (prohibition of torture) on technical grounds. The ECHR held that the Dedvukajs and other applicants failed to meet the six-month requirement for reporting the torture to the ECHR, and yet Rrok Dedvukaj, on September 27, 2006, and Kola Dedvukaj, on September 29, 2006, had submitted statements that were stamped by the Ministry of Justice in Podgorica.   They maintained this complaint at every stage, culminating in their application to the ECHR. It also dismissed Kola Dedvukaj’s claim that he did not receive adequate medical treatment in prison and stated that he had never submitted proof of his torture to anyone except his lawyer.

 

The ECHR ruled in favor only of Pjetar Dedvukaj’s complaint concerning ill-treatment admissible under Article 3 and required Montenegro to pay him 3,000 euros for non-pecuniary damages and 3,500 euros for his costs and expenses.

 

In reaction to the ruling, Shirley Cloyes DioGuardi said that it “set a precedent by rejecting Montenegro’s attempt to block Albanians from appealing to the court by relying on the requirement for all domestic legal remedies to be exhausted.”  The ECHR stated that the applicants had submitted their applications to the court long before the constitutional appeal could have become an effective domestic remedy in Montenegro.

 

Nevertheless, Cloyes DioGuardi said, that “since the ‘Second Section’ of the ECHR found no violation of Articles 3 and 6 for Kola Dedvukaj and Rrok Dedvukaj, the Albanian American Civic League is disappointed with the court’s decision and will give consideration to appealing to the Court’s ‘Grand Chamber.’”

 

After waiting nearly five years for a judgment in this case, Cloyes DioGuardi said that “the Civic League is concerned with the ECHR’s apparent failure to even consider, no less address, one of the central arguments of the Dedvukajs’ complaint:  namely that they had not been afforded a fair trial because they were never given an opportunity at trial to challenge the contents of Anton Sinishtaj’s diary and the statements of a co-accused who did not give evidence.”

 

Cloyes DioGuardi concluded by asserting that, “While Montenegro aspires to be a member of the European Union and NATO, it is not yet a free, open, and democratic society that respects the human and civil rights of all of its citizens, especially its ethnic Albanian population which has a history of nonviolence in Montenegro in spite of Slavic repression and oppression.”

Nju Jork, Nju Jork, 25 Nëntor 2015 – Gjyqi Evropian për të Drejtat e Njeriut në Strasbourg, Francë, ka dhënë verdiktin për rastin Kola Dedvukaj e Rrok Dedvukaj vs. Mali i Zi me 24 Nëntor 2015. Dedvukajt (që nuk kanë lidhje familjare) janë përfaqësuar nga Steven Powles—një specialist i të drejtës ndërkombëtare kriminale dhe të drejtave të njeriut—i cili u angazhua nga Liga Qytetare Shqiptaro-Amerikane në vitin 2009, menjëherë pasi Kola dhe Rrok Dedvukaj u liruan pas tri vitesh burg në burgun federal në Podgoricë.

 

Powles, një avokat pranë firmës Doughty Street Chambers në Londër, ishte pjesë e një ekipi ligjor me të cilin Këshilltarja për Cështje të Ballkanit, Shirley Cloyes DiOGuardi dhe Kryetari i LQSHA-së, ish-Kongresisti Joe DioGuardi, kishin bashkëpunuar edhe më pare për mbrojtjen e UCK-së. Powles ishte njëri nga avokatët që mbrojti Ushtrinë Clirimtare të Kosovës në Tribunalin e Hagës mbi Ish-Jugosllavinë, dhe kontribuoi në lrimin e Fatmir Limajt e Isak Musliut në vitin 2005.

 

Prej Shtatorit 2006 deir më 2009, Liga Qytetare Shqiptaro-Amerikane ka bashkëpunuar me një numër Anëtarësh të Kongresit të SHBA-ve, duke përfshirë edhe tanimë të ndjerin Tom Lantosh, Kongresistin Dana Rohrabacher, Kongresisten Ileana Ros-Lehtinen, si dhe atëherë Senatorin Joe Biden, për të siguruar lirimin e katërmbëdhjetë shqiptarëve, ku përfshiheshin edhe këta dy shqiptaro-amerikanë, të cilët ishin arrestuar, burgosur, e torturuar në Mal të Zi në Shtator 2006 nën dyshimin e kryerjes së aktiviteteve terroriste. Kur i gjithë ky proces, duke përfshirë edhe apelet e bëra tek Kryeministri Gjukanoviq dhe ai Sturanoviq për lirim, nuk dhanë rezultat, atëherë Liga Qytetare vendosi ta padisë Republikën e Malit të Zi në gjyq.

 

Kërkesëpadia e cila iu dorëzua Gjyqit Evropian për të Drejtat e Njeriut (ECHR) nga Steven Powles në Janar 2010, kishte parashtruar shkeljen e këtyre të drejtave ndaj të burgosurëve:

 

Neni 3 (ndalimi i tortures), ku jepen detaje për torturimin e Dedvukajve, trajtimin e tyre jonjerëzor dhe degradues nga policia malaziase kur këta ishin arrestuar në mëngjesin e 9 Shtatorit 2006, dhe ku dokumentohet mungesa e cfarëdo hetimi zyrtar ndaj kësaj cështje;

 

Neni 5 (mungesa e lirisë dhe sigurisë së personave), ku shpjegohet se Dedvukajt nuk ishin te informuar sic duhej në lidhje me arsyet e arrestimit të tyre apo ndonjëres nga akuzat ndaj tyre, dhe se ata u mbajtën në burg pa aktakuzë nga 6 Shtatori 2006 deri në Dhjetor 2007;

 

Neni 6 (e drejta për gjykim fer), ku evidenca kryesore kundër Dedvukajve që u mor për bazë në dënimin e tyre, ishte një ditar i Anton Sinishtajt, i cili ishte sekuestruar në mënyrë joligjore, dhe Dedvukajt nuk ishin të lejuar të shqyrtonin deklaratën e Sinishtajt dhënë për policinë;

 

Neni 14 (ndalimi i diskriminimit) mbronë individët nga diskriminimi në cfarëdo baze si raca, gjuha, feja, gjinia, apo besimi politik. Kërkesëpadia thekson se mosofrimi i një gjyqi me pesë gjyqtarë, por i vetëm një gjyqi me tre gjyqtarë për të dëgjuar dhe vendosur rastin e Dedvukajve në Podgoricë, duket të ketë qenë rezultat i një vendimi arbitrar dhe diskriminues për shkak të etnicitetit të tyre shqiptarë.

 

Kërkesëpadia e paraqitur nga Steven Powles ishte bashkangjitur me atë të Sinishtajt dhe të Tjerëve vs. Mali i  Zi. Avokati i Sinishtajt kishte apeluar lendën edhe në Gjykatën Supreme e atë Kushtetuese të Malit të Zi, gjë që nuk e kishte bërë avokati local, Kol Camaj, i cili përfaqësonte Dedvukajt deri sa ata u liruan nga burgu në vitin 2009.

 

Gjyqi vendosi të hedhë poshtë kërkesëpadinë për shkelje të Nenit 3 (ndalimi i tortures) për arsye teknike. Gjyqi Evropian për të Drejtat e Njeriut, ECHR, theksoi se Dedvukajt dhe të Tjerët kanë dështuar që të raportojnë torturën në ECHR brenda periudhës ligjore prej gjashtë muajsh nga data kur tortura kishte ndodhur, përkundër faktit që Kola Dedvukaj më 27 Shtator 2006 dhe Rrok Dedvukaj me 29 Shtator 2006 kishin dhënë deklarata të vulosura në Ministrinë e Drejtësisë së Malit të Zi, mu për këtë cështje. Ata e kishin ripërsëritur këtë akuzë cdo here deri në kuliminimin e saj në këkresëpadinë e ngritur pranë ECHR. Gjyqi përjashtoi kërkesën e Kola Dedvukajt për mosofrim adekuat të ndihmës mjekësore sa ishte në burg dhe shtoi se ai kurrë nuk kishte paraqitur ndonjë dokument për torture tek askush tjetër pos avokatit të tij.

 

ECHR vendosi në favor të Pjetar Dedvukajt për keqtrajtim, në kuadër të Nenit 3, duke e obliguar Malin e Zi që t’i paguaj atij një shumë prej 3000 Euro për dëme emocionale dhe 3500 Euro tjera për shpenzime ligjore.

 

Në lidhje me këtë verdikt ka reaguar Shirley Cloyes DioGuardi e cila ka thenë: “ky verdikt ka vendosur një precedan duke refuzuar përpjekjen e Malit të Zi për të bllokuar shqiptarët nga apelimi ndaj drejtësisë vendore në instanca të drejtësisë ndërkombëtare, duke u thirrur në kriterin se së pari duhet harxhuar të gjitha instancat ligjore vendore.” Vendimi i ECHR-së tutje shton se aplikantët paraqitën kërkesëpadinë e tyre pranë këtij gjyqi shumë më përpara se të pritnin ndonjë rezultat nga apeli në Gjykatën Kushtetuese të Malit të Zi, dhe se ky veprim ka qenë i drejtë.

 

Sidoqoftë, Cloyes DioGuardi ka thenë se “pasi që ‘Seksioni i Dytë’ i ECHR-së nuk gjeti shkelje të Nenit 3 dhe 6 për Kola Dedvukajn dhe Rrok Dedvukajn, Liga Qytetare Shqiptaro-Amerikane është e zhgënjyer me vendimin e gjykatës dhe se po konsideron apelimin e këtij vendimi në ‘Dhomën e Madhe’ të Gjykatës.”

 

Pasi është pritur mëse pesë vite për këtë verdikt, Cloyes DioGuardi tha se “Liga Qytetare është e preokupuar me dështimin e dukshëm të ECHR-së për të konsideruar të paktën, por pse jo edhe për të adresuar, njërin nga argumentet kyc të kërkesëpadisë së Dedvukajve: faktin që atyre nuk iu ofrua një gjykim fer sepse ata asnjëherë nuk paten mundësinë që gjatë gjykimit të sfidojnë përmbajtjen e ditarit të Sinishtajt dhe deklaratat e një të bashkë-akuzuari i cili nuk kishte dhënë ndonjë dëshmi.”

 

Cloyes DioGuardi përfundoi duke thenë se “gjerësa Mali i Zi aspiron të jetë një shtet anëtar i Bashkimit Evropian dhe NATO-s, ai ende nuk është një vend i lire, i hapur, dhe demokratik i cili respekton të drejtat njerëzore dhe qytetare të të gjithë qytetarëve të vet, e vecanërisht ato të populates enike shqiptare, e cila ka një histori të rezistencës paqësore kundrejt represionit të vazhdueshëm sllav ndaj tyre.”
