Judicial System

Corruption in the Albanian judicial system is widespread and a very high risk for businesses. Bribes are often exchanged for favorable judicial decisions, and judges and prosecutors lack accountability (GCR 2015-2016; EU Progress Report, 2015). Public perception reflects this, as more than three-quarters of surveyed citizens believe the judiciary is corrupt (the judiciary is ranked as the most corrupt institution among the 12 institutions included in the survey) (GCB 2013). On numerous occasions, judges and prosecutors have failed to comply with declaration of asset requirements, yet no sanctions have been issued to date (EU Progress Report, 2015). Although the Constitution provides for an independent judiciary, in practice the courts are subject to political pressure and intimidation (HRR 2015). The process of appointing judges is also opaque and plagued by corruption (EU Progress Report, 2015). In addition, the enforcement of court decisions is weak, particularly when they conflict with the government’s interests. There is also an apparent failure of the judiciary to properly prosecute the abuse of functions, which is pervasive among the political elite (BTI 2016). When sanctions in corruption cases are imposed, they are overly lenient (EU Progress Report, 2015).

Companies in Albania do not perceive the legal framework to be efficient when settling disputes or when challenging regulations (GCR 2015-2016). The business community believes the judiciary is an impediment to conducting business, so international arbitration is often sought as an alternative to dispute settlement (ICS 2016). Albania is a member of the International Centre for Settlement of Investment Disputes (ICSID) and is a signatory to the New York Convention 1958 on the Recognition and Enforcement of Foreign Arbitral Awards.

Erste, Sberbank and the EBRD have been fueling the destruction of 27 km of rivers in the region of Josanicka banja, on the borders of the Kopaonik National Park in Serbia. It is a stark warning how the future of the Balkans might look if uncontrolled investment in the hydropower sector continues.

It perplexes me why bankers investing in hydropower projects in the Balkans have been so short-sighted as to pour at least EUR 700 million (and probably much more) into hydropower projects that are seriously damaging nature and causing conflicts with local communities.

Finance is essentially a forward-looking enterprise: as a financier you are looking to future yields to cover the present investment. You are guessing the future value of money, and assessing the risks to find the best model for financing an endeavour or project.

It has long been recognised by companies and banks – at least in theory – that financial gains mean little without taking social and environmental impacts into account and looking at the real life consequences of financing decisions. The future of hydropower, even small scale, is not as green as it seems.

Following field visits in Albania and Macedonia in 2017 to see the real-life impacts of projects already built, Bankwatch recently teamed up with local activists and visited 14 plants located within just 40 km2 on the borders of the Kopaonik National Park in Serbia.

What we witnessed is uncontrolled development of hydropower that has damaged no fewer than three rivers. Even greater damage could be done by at least another three plants planned in the area. Half of the 14 plants* we visited were financed by Austria’s Erste & Steiermaerkische Bank, four by the EBRD and one by Sberbank.

The Samokovska river in the Kopaonik National Park is still in a pristine state above the Velež hydropower plant. But not for long, as 5.9 km of the river is to be put in a pipeline for the Samokovska reka 1 plant.

 

Cumulative impacts

Make no mistake, this is an industrial installation: tonnes of concrete poured in to stop once mighty rivers and most of the life circulating in them: fish, stone crayfish and thousands of smaller organisms that render our rivers alive. Once upon a time these rivers hosted fish species such as Mediterranean barbel, Chub, Gudgeon and Sabanejewia balcanica – all on the IUCN red list, the latter of which is strictly protected in Serbia.

These plants are often called run-of-the-river: In reality they are anything but. Dams block the rivers’ flow and form quickly silted-up ponds. From these concrete obstructions, the water is put into pipes and diverted to the powerhouse further below. Between the dam and the powerhouse, a ‘biological minimum’ flow is supposed to be maintained. Once mighty rivers and mountain streams are turned into lifeless drainage channels.

So far we identified EUR15 million* pouring into the region for construction of the hydropower plants. This translates into 17.8 km of rivers put into pipes, and 9.2 km about to be, leaving river beds with low or no water during the dry months. This is in contravention of Erste’s rules that, among other things, require compliance with the EU Water Framework Directive, and stipulate that no adverse effects on critical natural habitats or critical freshwater resources are allowed.

Local people report that the rivers are completely drying up on a regular basis.

We visited the river in February when there were comparatively high water levels. However, even then, water levels were considerably lower downstream from the dams, sometimes going below the minimal requirements. For several of the plants it was obvious that even the minimal requirements were not complied with.

Fish passes

What hurts the most is the operators’ plain chutzpah in building and running the so-called fish passes. In theory, they are built to enable fish migration over dams. In practice, they are often intentionally blocked or require some serious aiming and jumping skills.

Banka Evropiane për Rindërtim dhe Zhvillim (BERZH) do të mbajë një mbledhje të hapur më 12 prill në projektin Trans Adriatic Pipeline (TAP), i cili parashikon transportin e gazit azerbajxhanas në Evropë.

Kjo është bërë e ditur nga burime zyrtare brenda bankës, sipas citimit të mediave azere, por ende nuk ka njoftim zyrtar. “Ky konsultim po organizohet për të rishikuar financimin. Ne presim që Bordi i Drejtorëve i EBRD-së do të diskutojë mbi financimit që do të jepet para fundit të vitit 2018. Përveç BERZH, Banka Europiane e Investimeve (BEI) do të diskutojë edhe shpërndarjen e kredisë prej 1.5 miliardë euro për TAP në shkurt 2018”- shkruajnë mediat azere.

Më herët, u bë e ditur se Banka Europiane për Rindërtim dhe Zhvillim (BERZH) pritet të disbursojë 500 milionë euro për projektin Trans Adriatic Pipeline (TAP) deri në fund të vitit 2018, nga burimet brenda bankës.

“Ne presim që Bordi i Drejtorëve të BERZH-së do të diskutojë projektin para fundit të vitit 2018. Aktualisht, projekti është në fazën e duhur të strukturimit. Nuk është praktika jonë të komentojmë fazat e përgatitjes së projektit apo kohën e tyre, por mund të themi se projekti po ecën sipas planit “, tha një burim i BERZH-it për gazetën azere Trend.

Projekti TAP ka kaluar shqyrtimin e konceptit dhe tani është në pritje të shqyrtimit të strukturës nga BERZH. Përfituesi i huasë është konsorciumi i TAP AG. Përveç BERZH, Banka Europiane e Investimeve (BEI) do të diskutojë edhe shpërndarjen e kredisë prej 1.5 miliardë euro për TAP në shkurt 2018.

TAP, me vlerë 4.5 miliardë euro, është pjesë e Korridorit Jugor të Gazit, i cili është një nga projektet prioritare të energjisë për Bashkimin Europian. Projekti parashikon transportin e gazit nga Shah Deniz Faza e Azerbajxhanit në vendet e BE-së.

Tubacioni do të lidhet me Gazsjellësin anadollian TANAP, në kufirin turko-grek, më pas do të drejtohet përmes Greqisë, Shqipërisë dhe detit Adriatik, para se të vijnë në breg, në jug të Italisë.

TAP do të jetë 878 kilometra në gjatësi (nga ku 550 kilometra i ka Greqia, Shqipëria 215 kilometra, deti Adriatik 105 kilometra dhe Italia 8 kilometra).

Aksionerët e TAP janë të përbërë nga BP (20%), SOCAR (20%), Snam S.p.A. (20%), Fluxys (19%), Enagás (16%) dhe Axpo (5%).

No less than 15 firms contracted to build the Trans Adriatic Pipeline (TAP) and the Trans Anatolian Pipeline (TANAP), the two main sections of the so-called Southern Gas Corridor, have been implicated in various forms of corruption in the past, according to a CEE Bankwatch Network report published today.
