The National Guard officers, Ndrea Prendi, Armando Kasaj and Margarit Kume are expected to give their depositions at the Penal Court this Wednesday. Meanwhile, the Prosecution is collecting additional documents for reinforcing their stance in order to change the house arrest order to imprisonment. 

But what was the stance of the Court and the Prosecution at the First Degree? The Prosecution says in a document secured by Top Channel that the investigation indicated that besides the death of the four victims, Ziver Veizaj, Hekuran Deda, Faik Myrtaj and Aleks Nika, six other citizens have been seriously wounded on the protests 21 January 2011. 

“Several vehicles have been damaged, 36 police officers and 25 demonstrators were wounded, together with a big number of National Guard officers”, the prosecution says.

The Prosecution declares that Ndrea Prendi has consumed the crimes of murder in qualifying circumstances in cooperation and power abuse.

“As regards the National Guard soldiers’ responsibilities, they have violated the Service Rules for Important Objects with severe consequences, a rule provided by article 42nd of the Military Penal Code”.

The Court says that the Prosecution claims that the pistol with the ID number p52796z is the one that Ndrea Prendi has used for causing the death of Faik Myrtaj.

But to this investigation phase, there are no evidence indicating that the gun has been used by him on January 21st. His driver, Margarit Kume, has tried to save Ndrea Prendi from his legal responsibilities and has changed his own pistol barrel with his chief’s.

The Prosecution claims that Kume owned another weapon, a pistol with the ID number p52778z. As for Prendi, the court listed the Prosecution’s requests that were addressed to the Council of Ministers for receiving the video files recorded by the security cameras. 

According to the court, on 17 February 2011, the General Secretary replied to them by saying that the main system cameras were not functional since 2009. But according to the court, the cameras were working and the Prime Min
