OSCE calls for clarity in Kosovo property laws

The OSCE is urging Kosovo to rectify its tangle of confusing property laws and practices.

The OSCE mission in Kosovo published a fairly scathing report last month on how the Kosovo judiciary has addressed property-rights disputes. Titled “Litigating Ownership of Immovable Property in Kosovo”, it criticises the current legal uncertainty and judicial practices in this area.

The OSCE, which has been monitoring property cases since 2004, said the country’s laws on immovable-property rights are “complex, often unclearly drafted, and scattered throughout a variety of instruments”. Together with a jumble of administrative decisions and court practices, they create a “complicated and seemingly impenetrable system for determining contests over … ownership”, it said.

According to the UN-administered Relief Web, the study found that Kosovo “courts often give greater weight to the testimony of interested parties than to documentary evidence”, demonstrating a pattern of faulty reasoning and improperly weighted evidence.

The courts often justify transfer of property without production of a legal contract, the study reported, which runs contrary to applicable law and is widely considered a dubious practise in a post-conflict environment with many absent or missing landowners.

According to the OSCE, courts often “failed to cite legal provisions supporting their decisions” and are too ready to “appoint temporary representatives for absent respondents without following proper procedures”.

Christopher Decker of the OSCE noted the problems implicit when ownership is such a tangle. “Proper adjudication of disputes … is important because it enforces the rule of law, it promotes human rights and it enables the return of displaced persons,” said Decker, adding that “economic development” requires transparent laws governing property ownership.

The turmoil and fighting of the 1990s made it difficult to determine ownership of Kosovo property. War destroyed many records, and departing Serbs moved cadastral registries to Serbia but may claim ownership of 58.79% of the land in Kosovo….

Led by Tirana Mayor and opposition leader Edi Rama, the municipality has undertaken a “one citizen — one tree planted” initiative to boost the “green dimensions of the city”.

Designed as a public-private partnership between Tirana’s businesses and residents, the initiative aims to plant trees in various parts of the city over the next two years.

According to a Tirana municipality statement, “the initiative is designed as a movement in which every citizen can contribute to create a more healthy environment,” while recognising the interest of private business as well.

Since November 2008, over 8,000 trees have been planted on 27 streets. The initiative is changing the city’s appearance, particularly in Tirana’s long-neglected suburbs.

Many view Rama’s effort as an election-year stunt. Fatos Lobonja, an independent social commentator and writer who spent 17 years in prison under the communist regime, called the initiative “a typical facade move by a facade man before the general elections” on June 28th.

Lobonja accuses Rama of ruining Tirana by issuing a large number of building permits and causing a construction boom in a concrete-covered city. “Even if [the initiative] is a good move, he is doing it to lie to the people, and most important, it is very late for this, as Tirana is now transfigured.”

Environmental experts say that augmenting green space requires building or expanding parks and other green areas, not just planting trees….

In einem sehr schwierigen Umfeld, was der Deutsche Botschafter Bernd Borchardt in Tirana übernahm, wo sich nur noch Alles um Mafiöse Bestechungs Geschäfte der Drogen Mafia und des verbrecherischen Lobby Verbandes DAW dreht, profiliert sich der Deutsche Botschafter, nachdem er klaren Abstand zu den Oppositions Banditen Ilir Meta und Edi Rama bezogen hatte! Niemand braucht diese Leute in der Politik, welche von den Georg Soros Verbrechern aufgebaut werden, denn vor 10 Jahren haben diese Ganoven den kompletten Polizei Apparat an die Mafia verkauft. Noch 2005 kostete der Polizei Chef Posten am Flugplatz Rhinas 250.000 $/Jahr an Fatos Nano zu zahlen.

Wie bewiesen ist wahrscheinlich bis heute die Steinmeier - Merkel Truppe nur ein Rad im Verbrecher Kartell von Georg Soros, welcher ganz offiziell den Drogen Handel ausbauen will, um die Welt Finanzen zu retten.

Deutschland als Motor für Betrug, Terror, Besetzung und dem Drogen Handel ist nun mal mehr wie peinlich, was hoch kriminelle Deutsche Politiker und allen voran die ICG Mafia und Joschka Fischer mit den Mafia Diplomaten ab 1999 installierte.

Wenn eine Botschaft, die Ratten wie ein Magnet angezogen hat, wie es durch IQ geschädigte Säufer Peter Kiwiett organisiert hat und die Dumke Bande, so ist es ausserordentlich schwierig, einen Neu Anfang der Botschaft zu betreiben. Insbesondere, wenn der Botschafter seinen Erst Job antritt, so kann man durchaus ein Lob für diesen Botschafter aussprechen. Voraussetzung wäre allerdings, das er sich auch von den kriminellen Umtrieben des unnützen Lobby Vereines DAW trennt!

Eines braucht Albanien bestimmt nicht mehr, das man die Joschka Fischer Verbrecher (neues BGH Urteil, was das Vermögen von J.Fischer in Frage stellt) Banden wie u.a. auch einen Helmut Kienzle weiter herum toben lässt in Albanien. Allein dieser Ganove Kienzle hat einen unermesslichen Schaden wie auch Joschka Fischer und die Vorgänger Botschafter in Albanien angerichtet.

Man kann nur hoffen, das es so weiter geht in Albanien und nach den Wahlen mit neuen Schwung die Reformen vorwärts getrieben werden.

Eine klare Aussage, wenn ein Botschafter mit dem PM Salih Berisha ein Projekt einweiht. Man hatte ja genügend Vorbilder mit den anderen Botschaftern, wie man sich profiliert und am Besten persönlich um Projekte kümmert und diese Projekte nicht den kriminellen GTZ und BMZ Horden überlässt.

Ganz neue Ausrichtung der Deutschen Albanien Politik, wo nun aktiv der Deutsche Botschafter wichtige Projekte einweiht und nicht irgendwelchen GTZ Consult Abzockern und Betrügern überlässt.

In diesem TV Video wird die neue Spanische Botschaft eingeweiht, aber am Ende des Videos ist der Deutsche Botschafter Borchardt zu sehen, wie er eng den Studentischen Austausch Dienst und die Förderung von Uni Projekte, selbst koordiniert.

Offensichtlich hat man das 10jährige Verbrecher System in der Kultur u.a. mit den Georg Soros Verbrecher Banden der DAAD und mit diesem primitiven Ganoven Helmut Kienzle beendet.Die Wende wäre sowieso gekommen, spästends mit einem neuen Aussenminister/in Ende 2009, denn die Steinmeier Banden mit ihren
Lobby Betrugs Vereinen, sind nun mal Weltweit out, inklusive dem Balkan und China.

Premier Berisha: Pogradec gets transformed into most favorite tourist resort thanks to investments made

Prime Minister Sali Berisha attended the inauguration ceremony of Pogradeci used water treatment facility, realized through a German government grant accorded via the German Bank KfW and co-financed by the government of Albania with about 10 million euro. This rather important investment for this town is the first phase of one of the components of the Project for Environmental Protection of Ohrid Lake. Attending the ceremony was the ambassador of the Federal Republic of Germany in Tirana Bernd Borchard.

 

Premier Berisha considered the investment rather important for the environmental protection of Ohrid Lake and together with other projects that are being implemented or are underway, will transform Pogradec into an important tourist resort of the country.

 

“Korçё-Qafё Plloçë highway is built and we shall inaugurate it in the coming days. The highway on the one hand and the wastewater treatment facility, canal system and the collector on the other transform Pogradec this current year into the most favorite resort of the country. I believe that the tourist influx will be the greatest ever recorded in the history of this town. Through protection of the lake, we have protected the life of our citizens, the unique and rare species which grow in this lake,” said the premier. 

 

On his part, ambassador Borchard said that Pogradec is part of the important areas of cooperation between Germany and Albania and emphasized that the reason of this status is that in this country cooperation functions well and success generates success.

 

“This project, - said ambassador Borchard- has been implemented in the context of a close cooperation to Albania economic development policies. In the framework of this cooperation, Germany has made it available for Albania a total amount of 800 million euro since 1988. Last year, we had the opportunity of doubling the amount that is put at the disposal of this cooperation and this is another indicator of the fact that success generates success. Last week, I had the opportunity of giving the German government OK for an additional one million Euro to the health sector.

Brav ist er, der Botschafter, wenn man sogar mit GTZ Geldern Wahlkampf für die Regierung finanziert, wie man auf den Plakaten ja gut erkennt.
