Rreshen-Kalimash road “devours” other 100 million USD
The Durres-Kukes road construction bill, the greatest public investment in Albania, doesn’t seem to have any intention to stop growing.

Top-Channel has learned that in the first five months of this year, the government has paid to Bechtel Enka Consortium an additional sum of 100 million USD for the works inside the tunnel. Official sources say that in the first five months of the year, the government has invested 22 billion ALL on the inner sources of our economy.

But 45.5% of these investments went to the Durres-Kukes highway. The cost of this road, which has put Albania’s finances in great difficulties, continues to grow despite the fact that its inauguration was made two years earlier, on June 2009. Even government’s official data show the cost of the road has gone to more than 100 billion ALL or 1 billion USD, surpassing the 10% of the GDP, setting a record not only for Albania.

The Durrws-Kukes bill, more specifically, the most expensive segment, the “Rreshen-Kalimash”, has spurred controversy between the government and the opposition. Two years ago there was also an investigation launched by the Prosecution. Although the Prosecution officially formulated the accusation for power abuse with damage of hundreds of millions of dollars, the trial was never held, because the terms of investigation set by the Court had expired.

Vjehrri i kandidatit për kryetar bashkie të Tiranës, Lulzim Basha, rezulton të jetë një nga personat me status të dyshimtë pranë firmës piramidale VEFA. Dokumentet e gjetura në dosjet e kompanisë vërtetojnë se, përveçse një nga drejtuesit e kompanisë së Vehbi Alimuçajt në Tiranë, Xhafer Isufi ishte edhe një nga klientët e kompanisë.

Xhafer dhe Xhane Isufi, vjehrri dhe vjehrra e kandidatit Basha, kanë punuar të dy si nëpunës të Alimuçajt, në degën e Tiranës dhe pranë arkës së kreditit. Një nga misteret më të mëdha të kompanisë VEFA, është zhdukja në mënyrë misterioze e shumave të konsiderueshme të cilat nuk dihet se ku kanë përfunduar.

Kontrata “speciale”

Një nga kontratat e Xhafer Isufit me kompaninë VEFA, në të cilën ishte i punësuar, është ajo me kod HBU, nr. kartele 7424 dhe me kontratë të tipit 6M8J. Sipas kësaj kontrate,
Xhafer Isufi ka derdhur në arkat e kompanisë VEFA 200 mijë lekë të reja si kapital dhe ka tërhequr më pas 3.517.270 lekë.

Plot 17,5 herë më shumë se sa ka derdhur. Sado të ketë qenë përqindja e interesit që ka përfituar Isufi nga Vehbi Alimuçaj, nuk ka logjikë të shpjegojë se si kapitali është rritur me 17,5 herë ose, e shprehur kjo në përqindje, 1750% të vlerës së investuar.

Nga ish-drejtues të filialeve të kompanisë VEFA mësuam se persona të veçantë brenda kompanisë gëzonin të drejtën e normave më të larta të fitimit, në raport me qytetarët e thjeshtë. Në këtë rang bënin pjesë edhe drejtuesit e filialeve, por ata kishin të drejtën e përfitimit rreth 2% më shumë se qytetarët e tjerë, por në asnjë rast nuk mund të
arrihet në të tilla përqindje.

“Vetëm Vehbi Alimuçaj mund të autorizonte tërheqje të tilla parash, jashtë logjikës me të
cilën funksiononte kompania. Arsyet i di vetëm Alimuçaj dhe ai që ka tërhequr, por gjithsesi e them me siguri se një kontratë me norma të tilla interesi nuk ekziston dhe një tërheqje e tillë është e pajustifikueshme”, shpjegon ish-funksionari i lartë i kompanisë.

Nga dokumenti që po i paraqesim lexuesit, dallohet qartë se gjithë qytetarët e tjerë kishin një tip kontrate, të përcaktuar se 6M5J, ndërsa emri i vetëm që ka një tip kontrate 6M8J është ai i Xhafer Isufit. Gjithashtu, e njëjta listë tregon se qytetarët e tjerë kanë marrë vlera parash të përafërta ose deri në dyfishin e kapitalit të investuar.

Një rast i vetëm është ai i një pagese që arrin në 5-fishin e kapitalit, ndërsa rasti i Xhafer Isufit është i pakrahasueshëm, plot 17 herë e gjysmë më shumë se sa ka investuar. Atëherë çfarë ishte realisht Xhafer Isufi brenda kompanisë VEFA?

Nga verifikimi i kodit te të gjithë emrave të shënuar në këtë listë pagesash, rezulton se kodi i tyre përfaqëson thjesht inicialet e emrit dhe mbiemrit, një verifikim që
lexuesi mund ta bëjë lehtësisht. Ndërsa në kartelën me numër 7424 kodi është HBU. Kush është ky person që ka depozituar këtë sasi parash në emrin e Xhafer Isufit dhe më
pas ka tërheqyr 17,5 herë më shumë se kapitali?

Er äussert sich nicht nur empört über die Anklage, obwohl die Fakten u.a. inzwischen um 400% gestiegene Kosten klar sind.

Er versucht die General Staatsanwaltschaft lächerlich zu machen, indem er von einer fabulösen Anklage spricht nur damit versucht er die Authorität der Staatsanwaltschaft zu untergraben. In Wirklichkeit hat Basha längst seine eigene Integrität untergraben und sein Ansehen bei den Albanern ist Null. Gerade solche Geschäfte gingen immer nur mit KOrruptions Geldern ab.

Judegs: “We have pronounced that the competences about Basha are to High Court”
The Second Degree Court has delayed the section about the Judge Fatmira Hajdari decision review. The reason of this was the resignations of two judges. They sad that are under interests conflicts because they have been pronounced about this case. Dalip Bushi justified himself saying that hi was pronounced once about this case, and according to article 141 on the constitution, the competences are only by the High Court because Basha is a deputy. This was the argumentation of Bushi about his resignation. These resignations have delayed the section until other two judges will replace them. The court decided that the next section will take place on the 2-d of February. But if calculations are right it is possible that this section will not take place ever because on the 30-th of January the High Court will examine the ‘Durres-Kukes” case. The Second Degree Court had to start yesterday the examination of the case. On the First Degree Court Fatmira Hajdari decided to spoil the minister of Foreign Policy by the charges, valuating the attorney actions as illegal. Lulezim Basha actually the minister of Foreign Policy, is under funds abuse accuses during the time he was minister of Transports. Valuating the First Degree Court decision as illegal, the attorney is asking the discharging of this decision and the documentation passing to the High Court, as the competent institution. The attorney will make an appeal about the Hajdari`s decision valuating it as partial. In hers decision Hajdari précised that the investigation is closed and any other action taken by the attorney will be illegal. As results on the attorney decision date 06.11.2008 about time extension, the last date to compile the documents is 06.11.2008. After this date the prosecutor could not do any other investigation. After the verification by the court of the documents and applying the articles 128, 129, 131 and 325 of the Penal Code Procedure decided to valuate null the two procedure acts token by the prosecutor Arben Kraja. Also the First and Second Degree Courts are pronounced on Basha`s Favour, it will be the high Court to decide about the minister’s destine. This court will valuate the case where are involved the ex minister of Transports Lulezim Basha and the ex juridic director of this ministry Andi Toma.
